Supreme Court Rule of Evidence 405
The Supreme Court granted the defendant’s PLA to determine whether (1) Rule 405, which allows specific instances of violent character where the victim is alleged to be the aggressor, allowed post-charged conduct to be admitted, and (2) the trial court erred by denying the defendant’s request to present evidence that he was acquitted of the propensity crime that the State presented to the jury.

Preliminary Hearings
The Supreme Court granted the State’s PLA to determine whether the trial court’s failure to conduct a preliminary hearing to establish probable cause as required by the Illinois Constitution was reviewable as second-prong plain error, as the appellate court had concluded that it was.
The Agency will reimburse for ARDC dues paid by Collective Bargaining Unit Attorneys for calendar year 2026. This will be done on an individual reimbursement basis.
Please note that in order to avoid reimbursement issues, all forms must be received no later than June 1, 2026.
